Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. OPEN TO LEGAL U.S. RESIDENTS WHO ARE CURRENTLY ATTENDING COLLEGE ON A FULL-TIME OR PART-TIME BASIS AS DEFINED BY THAT COLLEGE AS OF APRIL 1, 2007. CONTEST BEGIN APRIL 2, 2007 AND ENDS MAY 15, 2007. ENTRANTS UNDER THE AGE OF THE MAJORITY IN THEIR STATE SHOULD GET PERMISSION FROM THEIR PARENTS OR GUARDIANS TO ENTER THE CONTEST. VOID IN PUERTO RICO, GUAM, THE U.S.VIRGIN ISLANDS, AND WHERE PROHIBITED BY LAW.
Sponsor: Alloy Education, a division of Alloy Media, LLC, (“Sponsor”) is the sponsor and administrator of the Contest, and is responsible for the fulfillment of the prizes. Sponsor is responsible for the collection, submission or processing of entries and the overall administration of the Contest. Entrants should look to Alloy Education at 2 Lan Drive, Westford, MA 01886 (“Contest Address”) with any questions, comments or problems related to the Contest.
- Entry: Create a video or audio podcast about a college related subject such as: the admission process, the campus visit, student life, athletics, greek life, or anything else you think high school students should know about college life. By submitting a podcast, you represent and warrant that: (i) the podcast does not and shall not infringe on any copyright or any other third party right nor violate any applicable law or regulation, (ii) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright and other related rights to the podcast, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity, (iii) you hereby hold Sponsor and their respective parent, subsidiaries and affiliate companies, harmless from and against any third party claim arising from use of the podcast, and (iv)you waive any right to inspect or approve uses of the podcast or to be compensated for any such uses.
Ownership:
(a) Entries - All entries become the exclusive property of Sponsor and will not be returned. By entering this Contest, you consent to the display and transmission of your podcast, in whole or in part, in any and all mediums, including the Internet, throughout the world and with no time limit. You recognize that other persons including Sponsor employees may have submitted to Sponsor or to others or made public, similar material to that contained in your podcast which Sponsor may have the right to use, and you understand that you will not be entitled to any additional compensation because of Sponsor’s use of such other similar material; and you release Sponsor, its affiliated companies and Prize suppliers from any claims or liabilities with respect to Sponsor’s use of similar material.
(b) Grand Prize Winner - If you are determined to be the Grand Prize winner of the Contest, as a condition of the award, you will be required to assign to Sponsor all right, title and interest in your podcast, including the worldwide copyright therein and all renewals. If at any time Sponsor is not deemed the owner in the copyright in the podcast, you shall be deemed to have assigned such copyright (and renewal or extension, if applicable) to Sponsor. Sponsor shall have the unlimited, perpetual and exclusive worldwide right to utilize the podcast, in whole or in part, in any manner, form or medium, or refrain therefrom, at Sponsor’s’s sole and absolute discretion. You agree to sign any and all documents required to perfect Alloy’s rights in the podcast.
Mail Entry: You must submit your podcast on a compact disc and, along with this submission, you must handwrite on a card no larger than 4 ½ inches by 6 inches, your first and last name, mailing address, date of birth, and phone number. The compact disc and handwritten card must be mailed together in a postage paid envelope to Alloy Education, Attn: Podcast Competition, 2 Lan Drive, Suite 100, Westford, MA 01886.
All entries must be postmarked on or after April 2, 2007 and no later than May 15, 2007 and must be received no later than May 21, 2007.
You can enter only once. Automated or robotic entries submitted by individuals or organizations will be disqualified. Multiple entries will be disregarded.
By entering the Contest, you represent and warrant that you have read all of the official rules of this Contest and are fully familiar with its contents.
- Eligibility: Employees (and employees’ immediate family defined as mother, father, in-laws, grandmother, grandfather, brother, sister, children, grandchildren or household members) of Sponsor and its parent, affiliates, subsidiaries, suppliers, printers, distributors, advertising and promotional agencies, and prize suppliers are not eligible to participate.
- Privacy: By entering a Contest, you agree to Sponsor’s use of your personal information as described in its Privacy Statement at http://careersandcolleges.com.
- Winner Selection: All eligible entries received by the Sponsors will be judged to determine three finalists on or about June 15, 2007, according to the following criteria: originality 30%, creativity 30%, production value 20% and relevance to high school students 20% (the “Judging Criteria”). Winning entrants (each, a “Winner” and collectively, the “Winners”) will be notified by phone. The Sponsor shall have sole discretion as to the Judging Criteria. A potential winner must accept a prize within three (3) business days of notification by either email or telephone. Any Winner notification not responded to or returned as undeliverable may result in prize forfeiture and an alternate winner shall be selected based on the Judging Criteria. The potential Winner and, if the potential Winner is under the age of the majority in their state, the potential Winner’s parent or guardian, will be required to sign and return an affidavit of eligibility and release within fourteen (14) days of notification. In the event of non-compliance within this time period, an alternate winner will be selected based on the judging criteria. The Sponsor shall not permit any substitution or transfer of a prize. The Sponsor is not responsible if an entrant’s telephone does not work and/or may disqualify an entrant if the entrant’s telephone does not work or if entrant’s telephone number or street address, as applicable, is changed.
- Prizes:
One (1) Grand Prize – the Grand Prize Winner will receive a $5,000 scholarship payable to the institution they are attending (the “College”). The scholarship must be utilized for expenses related to attending a College as such expenses are defined by then current SallieMae regulations. The scholarship shall be paid directly to the Winner’s College upon receipt of an invoice for such purposes as by the Winner to Sponsor. There is no retail price attributable to the scholarship, however, in the event taxing authorities determine that the scholarship is otherwise taxable, the winner shall be solely responsible for such taxes.
Two (2) First Prizes – Winners will each receive a digital camcorder, make and model to be decided by Sponsor in Sponsor’s sole discretion. Approximate Retail Value “ARV” $300 each.
TOTAL APPROXIMATE RETAIL VALUE OF ALL PRIZES: $600
The Sponsor reserves the right to substitute the prize, or portion of the prize, for another prize of equal or greater value. The ARV of the prize represents the Sponsor’s good faith determination, which determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash.
- General Conditions: Only one prize per person per household per email address awarded. The Contest is governed by the laws of the United States. All federal, state and local laws and regulations apply. The Contest is not to be used in connection with any form of gambling. Prize will only be awarded and/or delivered to addresses within the United States. All taxes, fees, and surcharges are the sole responsibility of the Winner. Failure to comply with any of these Official Rules will result in forfeiture of the prize. If prize is forfeited, the prize will be awarded to the entrant with the next best entry as determined by the judges in their sole discretion utilizing the judging criteria of the Contest. If a First prize winner is elevated to the status of Grand Prize winner as a result of a forfeiture, then Sponsor shall have the right to require that such winner return the First Prize or, in the alternative, reduce the scholarship awarded by the value of the First prize. No more than the advertised number of prizes will be awarded.
Except where prohibited by law, each Winner (and parent/legal guardian if Winner is a minor) grants (and agrees to confirm that grant in writing) permission for Sponsor, its advertising and promotional agencies, and those acting under the authority of each to use such Winner’s name, photograph, voice and/or likeness, whether or not incorporated in the podcast, for advertising and/or publicity purposes in all media now known or hereafter discovered, worldwide and on the world wide web, without notice, review, approval, or additional compensation. Entrants further agree that Sponsor, and its parent, subsidiaries and affiliated companies, advertising and promotion agencies, suppliers, printers, distributors, and the respective officers, directors, employees, representatives and agents of each (together the “Contest Entities”) will have no liability whatsoever for, and shall be held harmless by entrants (and parent/legal guardian if entrant is a minor) against, any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize participation in this promotion, or while traveling to, preparing for or participating in any prize-related activity. The Contest Entities expressly disclaim any responsibility or liability for injury or loss to any person or property in connection with the delivery and/or subsequent use of the prizes awarded. Sponsor makes no representations or warranties concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations apply. Any lost or stolen prize items will not be replaced. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. In addition, any dispute relating to the Contest (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in the City and County of New York. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction they may have.
- Conduct: By entering the Contest, entrants agree to be bound by these Official Rules. The Official Rules will be posted at the Contest Site throughout the Contest. Entrants further agree to be bound by the decisions of the judges, which are final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of any of the Contest or any website; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY DELIBERATE ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF ANY OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
- Limitations of Liability: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest. Sponsor assumes no responsibility for any misdirected or lost mail, or any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to entrants’ or to any website or to any other person’s computer related to or resulting from participating or downloading materials in the Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right at their sole discretion to cancel, terminate, modify or suspend the Contest.
- Winner’s Lists & Official Rules: To obtain a printed copy of the names of the Winners or a copy of the Official Rules by mail, send the applicable request and a self-addressed, stamped #10 envelope to: Alloy Education, 2 Lan Drive, Westford, MA 01886. Request must be received no later than November 1, 2007.
